BY-LAW NO. EC-09

A BYLAW RESPECTING REMUNERATION OF FIREFIGHTERS FOR EASTERN CHARLOTTE

 

BE IT ENACTED by the Council of Eastern Charlotte under the authority vested in it by the Local Governance Act, R.S.N.B. 2017, c. 18, as follows:

 

1. TITLE

a) This by-law shall be cited as the “Remuneration of Fire Fighters By-Law”.

 

2. DEFINITIONS

In this By-Law, unless context otherwise requires:

a) "Battalion Chief" means the person in leadership overseeing District Chief(s), reports to Fire Chief;

b) "Call" means the fire call, alarm or request for response;

c) "District Chief", may be referred to as “Station Chief”, means the person in leadership overseeing care and maintenance of a designated fire station;

d) "Driver On-Call" is a designated person who will be responsible for being the primary driver of a fire-fighting vehicle during a scheduled period of time, and will also be responsible for cleanliness of designated fire station and trucks during the scheduled period to time;

e) “Half Day” training means a maximum of four (4) hours of training, course or special assignment by the Fire Chief;

f) "Fire Chief" means the Fire Chief of the municipality of Eastern Charlotte;

g) "Fire Department" means the Eastern Charlotte Fire Rescue and all departments or sections that are encompassed under such, either current or former, which include the St. George Fire Department, Eastern Charlotte Regional Fire Service, and Fundy Bay Fire Department;

h) “Full Day” training means training, courses or special assignment by the Fire Chief of over four (4) hours;

i) “Training” means any Member attending and participating in training, courses and activities;

j) "Volunteer Firefighter" means any volunteer firefighter.

 

3. RATES

a) The salaries for volunteer command positions per year shall be:

i) The salary for the Battalion Chief per year shall be: $5,250.00

ii) The salary for the District Chief per year shall be: $4,000.00

b) The rate of pay for each Call shall be: $26.02

c) The rate of pay for each training day shall be: $20.00 half day, $50.00 full day.

d) A Driver On-Call shall be reimbursed, per each weekend day, and Statutory Holiday for the Province of New Brunswick, of being on-call, at a rate of: $133.00

e) All officers and firefighters are deemed volunteers, and as such, are not entitled to benefits or agreements of a staff member of the municipality of Eastern Charlotte.

f) Renumeration and payments shall be paid on the final pay week of each month.

g) Renumeration rates will be increased each year at a minimum rate of 2.00%.

 

4. FOREST FIRES/PROVINCIAL OPERATIONS

Stipends paid to Firefighters for Provincial Operations (such as forest fire fighting under the authority of the Province) shall be paid directly to the firefighter upon the next payment schedule, outlined under 3.f., after receipt from the Province.

 

5. EXPENSES

Any reimbursement of expenses by a Member of the Fire Department shall require preapproval by the Fire Chief and shall be in accordance with Policy# 01-2023 - Human Resource Policy for the Municipality of Eastern Charlotte.

 

6. REPEAL OF EXISTING BYLAW & POLICY

The enactment of this by-law repeals the following by-law and policy:

a) By-Law # 84, Respecting the Remuneration of Firefighters, for the Town of St. George

b) Policy # 46, Remuneration Policy for the Blacks Harbour Volunteer Fire Department

 

7. ENACTMENT

IN WITNESS WHEREOF the local government of Eastern Charlotte has caused its corporate seal to be affixed to this By-Law, the 15 day of November, 2023.
