
BY-LAW NO. EC-15A BYLAW RESPECTING MAYORAL REPORTING AND

PURPOSE: A By-Law of Eastern Charlotte, in the Province of New Brunswick, for the purpose to promote transparency, accountability, and informed governance by mandating regular reporting of the Mayor of Eastern Charlotte to Council regarding matters discussed at the Southwest New Brunswick Service Commission (SNBSC). WHEREAS: the Southwest New Brunswick Service Commission (SNBSC) provides services and regional decision-making that directly affect the residents of Eastern Charlotte; WHEREAS: transparency and communication of SNBSC matters are essential for public accountability and informed governance; WHEREAS under Section 48(1)(c) of the Local Governance Act (New Brunswick), the mayor of a local government shall "communicate information and recommend actions to council for the improvement of the local government’s finances, administration and government"; WHEREAS under Section 48(1)(d) of the Local Governance Act, the mayor shall "speak on issues of concern to the local government on behalf of council"; AND WHEREAS under Section 48(2) of the Local Governance Act, the mayor is “subject to the direction and control of council and shall abide by the decisions of council”; BE IT ENACTED by the Council of Eastern Charlotte under the authority vested in it by the Local Governance Act, R.S.N.B. 2017, c. 18, as follows:
TITLE 1 This by-law shall be cited as the “Mayoral SNBSC Reporting By-law”. DEFINITIONS 2 In this By-law, unless context otherwise requires:
DUTIES OF THE MAYOR REGARDING SNBSC MEETINGS 3(1) The Mayor shall provide a verbal or written summary report of any Regular Board Meeting, or Annual General Meeting (AGM), of the SNBSC attended in the capacity of a voting member, within thirty (30) days of the meeting date. 3(2) The report shall be presented at a Regular Meeting of Council and entered into the minutes. 3(3) The Mayor may delegate this duty to an alternate representative if authorized under the SNBSC’s procedural rules. PUBLIC ACCESS 4 A copy of each SNBSC report shall be made available on the official Eastern Charlotte website within ten (10) days after presentation to Council. NON-COMPLIANCE 5 Failure to comply with this by-law shall be recorded in the official minutes and may be subject to further corrective actions, including censure, as deemed appropriate and necessary by Council. ENACTMENT 6 IN WITNESS WHEREOF the local government of Eastern Charlotte has caused its corporate seal to be affixed to this By-Law, the 18th day of September, 2025.
